And as to when will this go to trial. Your guess is as good as mine, but I can see this case will eventually go to trial, and in a district that voted massively against the former President in both 2016 and 2020.

ReplyDeleteThe charged are for falsifying business records (the hush money payments). However for this to be a felony in NY in the falsification needs to be in support of or to conceal another crime...the other crime in this case is violation of federal election laws (hush money was meant to keep voter opinion favorable to Trump and was part of his campaign spending).

For the felony charge the "other crime" that the business falsification would have been in support of is a federal crime not a NY crime...also even it can be prosecuted in NY, for it to be a federal crime it has to be proven that his intent was primarily to influence the outcome of the election when he may have plausibly had other motivations. Also there is potential statute of limitations.
Anyway it is complicated but primarily about falsification of business records which without another crime would likely just be misdemeanor beyond statute of limitations.

While it is true that the trial if held in Manhattan would be held in Dem territory--and that is why the GOP hopes to move it to Staten Island if held in Red County, village, the city would also appear "fixed." Hmmm well the indictment is for multiple different versions of "falsifying documents" that concern almost no one in the citizenry of that state.
