* Smollett was facing 48 years behind bars on 16 felony charges for allegedly lying to police about the attack

The incredulous mayor of Chicago said on Wednesday that prosecutors' decision to drop all the charges against Jussie Smollett made 'fools of all of us' as he demanded answers as to why the Empire star was able to escape 'scot-free' despite the State's Attorney's office still believing he is guilty of staging a hoax hate crime.

Smollett, 36, walked out of court on Tuesday a free man after secretly completing 16 hours of community service and forfeiting $10,000 in bond.

Assistant State's Attorney Joe Magats said that even though he does not believe the star is innocent, his office had suddenly decided not to pursue charges because Smollett has a 'lack of criminal background' and was not a threat to the community.

No other explanation for the sudden about-turn has been given and critics, including the 'furious' police chief who led the investigation into the attack, are enraged that not only has Smollett's record been expunged, but a judge has sealed the case meaning none of the evidence will become public.

The Cook County courthouse has also revealed that every trace of the case has been wiped from its systems and, to clerks' surprise, no written motions were filed in court yesterday, making it as though the charges 'never existed.'

Tuesday's terror attack in New York was the city's deadliest since 9/11. Sayfullo Habibullaevic Saipov drove a rented van down a bike path, law enforcement sources have said. The attack killed six victims instantly, while two others died later. New York politicians and officials quickly labeled the incident a terror attack.

Trump's comments, made during a White House Cabinet meeting Wednesday, malign the justice system for a lack of toughness. Attorney General Jeff Sessions, the head of the so-called 'laughing stock' justice system, was in the room for this comment -- sitting across from Trump.

Reuters: Courts likely to probe Trump's intent in issuing travel ban

Washington state’s attorney general has promised to uncover "what truly motivated" President Donald Trump's executive order on immigration, an approach that could prompt a rare public examination of how a U.S. president makes national security decisions.

The presidential order imposed a temporary ban on travelers from seven predominantly Muslim countries, but a federal judge has barred enforcement of the order while the court considers a challenge brought by Washington state.

On Thursday, the U.S. Court of Appeals for the 9th Circuit left the judge’s ruling in place without deciding the ultimate merits of either side’s arguments. In its decision, the 9th Circuit cited a previous case establishing that “circumstantial evidence of intent, including … statements by decisionmakers, may be considered in evaluating whether a governmental action was motivated by a discriminatory purpose.”

A Navy sailor was sentenced to a year in prison for taking photos of classified areas inside a nuclear attack submarine despite his pleas that it was similar to how Hillary Clinton used a private server to send classified emails.

Kristian Saucier, of Arlington, Vermont, appeared in federal court in Bridgeport, Connecticut on Friday where a judge also ordered him to serve six months of home confinement with electronic monitoring during a three-year period of supervised release after the prison time.

He pleaded guilty in May to unauthorized detention of defense information and had faced five to six years in prison under federal sentencing guidelines.

Will other careless security-clearance holders get a pass? Time will tell.

Attorneys for people who allegedly mishandled classified information say the outcome of the FBI’s investigation into Hillary Clinton could be good news for their clients.

Though many see a double standard in FBI Director James Comey’s decision not to recommend charges against the former secretary of state who used a personal and unsecured email system for official business, others see possibilities.

Mark Zaid, a defense attorney for national security whistleblowers and people accused of mishandling secrets, says he plans to ask for “the Clinton deal” in the future.

And Zaid says he probably can get it.

Is the military’s law making adultery a crime unconstitutional? So says a colonel who’s been charged with violating it. His motives aren’t great -- he’s trying to deflect attention from more serious charges, including rape. But he may be right. The law arguably discriminates by criminalizing only heterosexual adultery. And even if that vestigial aspect of the law could be fixed, there’s another problem: the anti-adultery law violates the fundamental right of privacy, which should extend even to armed-forces personnel, whose constitutional rights are limited by military necessity.

The issue has arisen in the context of a court-martial against U.S. Air Force Colonel Marcus Caughey. He’s been charged with rape, assault, taking a sexual selfie -- and six counts of adultery. Under the Uniform Code of Military Justice, which governs uniformed personnel, adultery is a crime. Military prosecutors typically add the charge when a defendant is accused of other crimes. It gives them extra leverage, but also provides room for the factfinder, whether judge or jury, to reach a compromise verdict and find the defendant guilty of adultery even if it doesn’t find him guilty of rape or assault.

The old Army adage, “Hurry up and wait,” applies once again to a decorated Green Beret who protected an Afghan boy from a child molester only to see his actions jeopardize his military career.

A decision from the military on the fate of Sgt. First Class Charles Martland was due Tuesday, but now has been put off for a third time, until at least May 1. Martland, an 11-year Special Forces veteran, was stationed in Afghanistan in 2011 when he confronted a local police commander who allegedly had raped a 12-year-old boy.

“Charles did the right thing in Afghanistan by standing up to a child rapist and corrupt commander, and now it’s the Army’s turn to do the right thing and reverse the decision to expel him from the service,” Rep. Duncan Hunter, R-Calif., whose office has been assisting Martland, told FoxNews.com earlier this month. “Permitting Charles to continue serving is in the best interest of the Army and the nation.”

The US has relentlessly argued that targeted killings are legal under international law. The third world has to push back

My Comment: Some would say that rules of engagement are structured along legal rules and regulations that limit and/or hinder U.S. military operations. My Comment: When the marine urination video on a Taliban corpse went viral .... I said in this blog that while it was a wrong thing to do and they should be punished (albeit not severely) .... because the incident was rapidly becoming political (our Afghan allies were unhappy) .... these Marines were going to prosecuted BIG TIME. In one of the rare times when he has spoken during his court martial, US Army Pfc. Bradley Manning apologized Wednesday for leaking hundreds of thousands of classified documents when he was an intelligence analyst in Iraq.

FORT MEADE, MARYLAND — Lawyers for Bradley Manning, the U.S. soldier convicted of giving classified documents to WikiLeaks, sought to show during a sentencing hearing on Tuesday that the Army ignored his mental health problems and bizarre behavior.

Manning's violent outbursts and his emailing a supervisor a photo of himself in a dress and blond wig with the caption “This is my problem” were signs the gay soldier should not have a job as an intelligence analyst, defense attorney David Coombs told the court-martial.

Manning, a 25-year-old private first class, faces up to 90 years in prison after being convicted July 30 on 20 charges, including espionage and theft, in the biggest release of classified files in U.S. history.

Former Minnesota Gov. Jesse Ventura is setting his legal sights on the widow of a former Navy SEAL he had sued for defamation.

Lawyers for Ventura have asked a federal court to continue his lawsuit against Chris Kyle — who was killed in February by a young veteran he was mentoring — by substituting Kyle’s wife, Taya, as the defendant. Ventura last year sued Kyle, a decorated former SEAL and author of “American Sniper,” claiming that the book’s description of a California bar fight defamed him.

Army General Suspended After Fight With Mistress -- Washington Post

An Army brigadier general who commanded a South Carolina post has been suspended for allegedly having a physical altercation with a mistress, officials said Tuesday.

Brig. Gen. Bryan T. Roberts, the top commander at Fort Jackson, is the latest in a string of senior military officials who have come under investigation for alleged misconduct. The case comes amid an outcry from lawmakers and other critics who say the Pentagon is failing to address pervasive sexual harassment and assault in the ranks.

“The allegations are being thoroughly investigated,” said Harvey Perritt, a spokesman for the Army Training and Doctrine Command. Perritt said the Army’s criminal investigations division is handling the probe. Army officials did not say when the incident is alleged to have taken place or how it came to their attention. Perritt said Roberts would not be available to comment.

The surviving suspect in the Boston marathon bombings admitted to his role in the attacks to the FBI - but clammed up when finally read his Miranda rights.

It has been revealed that Dzhokhar Tsarnaev, 19, initially confessed to authorities that he and his older brother, Tamerlan Tsarnaev, 26, carried out the attacks during 16-hours of questioning over the weekend.

Dzhokhar has been communicating with law enforcement officials by writing on a pad after suffering an injury to his throat during the frenzied manhunt for him which renders him unable to talk.

(Reuters) - A decision to charge the Boston Marathon bombing suspect in a civilian rather than a military court means he will face the same legal process as other federal criminal defendants in U.S. courts.

Dzhokhar Tsarnaev, 19, was charged on Monday with using a weapon of mass destruction and malicious destruction of property resulting in death.

The White House said earlier that Tsarnaev, an ethnic Chechen who is a naturalized U.S. citizen, would not be treated as an enemy combatant for his alleged role in last week's bomb attacks, which killed three people and wounded more than 200.

These are the likely next steps in his case, legal experts said.

My Comment: My prediction .... this case will take a few years and millions in legal costs before a guilty verdict is delivered. And in the end .... he will not be executed for the simple reason that the lawyers and their psych specialists will make the case that he was "brainwashed" by his brother. If anything .... I can now see Dzhokhar Tsarnaev being released when he is in his 40s.
