That same question, in spades, could be asked by Matthew McCabe and his fellow Navy Seals who were charged with crimes related to the apprehension and detention of a terrorist who said he was “roughed up” by his guards.

My Comment: I am torn by this question. The U.S. Navy Seals do deserve compensation for their legal fees .... but by agreeing to this precedent, we are opening a Pandoras Box in which everyone will then start demanding the same treatment.
