Democrats Are Split On President Trump's Authority To Declare A National Emergency To Build Wall

Zero Hedge: Key Democrat Admits Trump Has Authority To Declare National Emergency To Build Wall

Democratic Rep. Adam Smith (D-WA), chair of the House Armed Services Committee, admitted that President Trump has the authority to declare a national emergency and have the military build a wall along the US-Mexico border.

ABC's "This Week" host George Stephanopoulos asked Smith "Does President Trump have the ability, have the authority to declare a national emergency and have the military build his wall?"

"Well, unfortunately, the short answer is yes," replied Smith. "There is a provision in the law that says the president can declare an emergency. It’s been done a number of times, but primarily it’s been done to build facilities in Afghanistan and Iraq. In this case, I think the president would be wide open to a court challenge saying, where is the emergency? You have to establish that in order to do this. Beyond that, this would be a terrible use of Department of Defense dollars."

WNU Editor: California Democrat Congressman Adam Schiff has a different take .... Schiff: Trump lacks power to declare wall emergency (CNN). What's my take? It all comes down to the following .... do you believe millions of migrants from the Americas who want to move to the U.S. without respecting U.S. immigration laws are a threat? For many Democrats and the media they do not see this as a threat. For others .... they do see a crisis .... After years of Trump's dire warnings, a 'crisis' has hit border but generates little urgency (LMTOnline). As to the polls, when asked specifically about illegal immigration the numbers support President Trump's position that this is a crisis, but are split on what to do about it .... Poll: 8-in-10 call illegal immigration a ‘problem,’ 58% say ‘serious’ (Washington Examiner). My prediction .... millions of Central Americans want to live in the U.S., and if given the chance almost all of them will leave today. The U.S. is not even remotely prepared to accommodate this influx of people.

the president can declare an emergency and legally get away with it. The problem though is that a lot of land that he wants to build on is private property and that will raise legal issues

Awesome. Declare a permanent state of emergency. Send all millennials to the concentration camps. Then flush $25 billion down the toilet on the wall. And a
moat. Only then will America be great and safe.

Great plan, glad you thought of it.

1. more than the 5 billion already lost in the cost of this shutdown of govt
2. the 800,000 federal workers get paid every two weeks...they will get a bit jumpy when they do not get paid
3. security of the nation already imperilled as security at airports not what they were to be,
4. all will be resolved when gop in senate either continue to support the president or drift away when it comes to votes
5. sit back and enjoy the nation as it does down the septic tank

Fantastic analysis.

Our beloved editor errs when he contrasts Dems as opposing border security with Trump favoring security...the issue really is how effective a wall would be...the caravan is NOT made up of jihadists but rather those seeking asylum, legally so...they are to be vetted. No one who is sane wants open borders with no vetting...have you ever gone from U.S. to Mexico without being stopped, coming or going?

Solving immigration and border security problems is a lose lose for democrats, they have taken the path of obstruct at all costs and there is no reason for them to change course, they (currently) have the voters backing.

Of course no one who's "sane" would want that, very astute observation.

Are you familiar with California’s sanctuary state laws? If they are not an open invite for anyone (regaurdless of criminal history) I don’t know what is. Now they still have to make it through the federal border area, but once that is achieved they are absolutely untouchable. So yeah no one wants an open border, but some people think that if you make it through the gauntlet you should be awarded with immunity...

Oh I'm quite familiar with California's state sanctuary laws.

This completely ignores the people crossing illegally via the open borders. Lots of evidence that this is going on, but if sticking you head in the sand is a good answer than so be it.

lots? present a few examples or evidence

Pretty hard to send anyone to a concentration camp without a time machine!.
Or do you refer to maintaining the borders of the U.S?,which seems to be standard practice for every other first world nation.
