Navy Times: Secret tracking device found in Navy email to Navy Times amid leak investigation raises legal, ethical questions

A Navy prosecutor last week sent an email to the editor of Navy Times that was embedded with a secret digital tracking device. The tracking device came at a time when the Naval Criminal Investigative Service is mounting an investigation into media leaks surrounding the high-profile court-martial of a Navy SEAL accused of war crimes.

That email, from Navy prosecutor Cmdr. Christopher Czaplak to Navy Times editor Carl Prine, came after several months of Navy Times reporting that raised serious questions about the Navy lawyers’ handling of the prosecution in the war crimes case.

WNU Editor: The U.S. military and the press have never had a good relationship. This is just watching the press using more advanced technology. Is it wrong .... yes. Will something be done about it .... we shall see.

The greater concern for me as a lawyer is the surreptitious violation of the attorney-client privilege. If the prosecutors knew this was taking place, they should be disciplined and possibly disbarred.

They're concerned about leaks and it looks like this is their tool to track down the culprit when classified documents actually do leak. At least that's the story the Navy's sticking to for now. Still, if it's against the law to harvest that information then it doesn't really matter if the intention in using it was to "spy" on anyone, you either try and make it legal or you just don't do it. Though I do feel like the headline is a bit sensational.

Corporate ownership changes often sometimes and can be complicated. I'll leave it at that.
