Miranda Rights Waived For Suspected al Qaeda Operative Abu Anas al-Libi -- Washington Times

U.S. authorities will interrogate suspected al Qaeda operative Abu Anas al-Libi aboard an American warship without reading him his rights, officials said Monday.

Al-Libi was captured from the streets of the Libyan capital of Tripoli in a U.S. military raid over the weekend. He will be in military custody for several more days or weeks aboard the USS San Antonio in the Mediterranean Sea, NBC News reported.

U.S. officials hope to get information about al Qaeda’s operations in Libya, but none of what al-Libi says can be used in a trial. The FBI could read him his Miranda rights later and seek to question him again, the report said.

My Comment: By not reading Abu Anas al-Libi his Miranda rights they are hoping that he will then "spill the beans" on Al Qaeda's operations in Libya knowing that such information can then not be used against him in his court case. This is unreal .... how can this foreign terrorist have any rights under the U.S. legal system? Sighhh .... I guess this is now standard U.S. policy on how they should conduct counter-terrorism operations. But here is an easy prediction .... Abu Anas al-Libi is going to plead that he is innocent, and he will give them zero intel.

Supreme Court Blocks Challenge To Anti-Terrorism Law -- USA Today

Court's conservatives deny lawyers, journalists and human rights activists the right to challenge the law because of the fear of future surveillance or the costs of guarding against it.

WASHINGTON -- One of the most controversial anti-terrorism laws passed in the wake of the Sept. 11, 2001, attacks may be beyond normal judicial review, the U.S. Supreme Court ruled Tuesday.

In a 5-4 decision, the court's conservative justices ruled that lawyers, journalists, human rights activists and others lacked standing to challenge a law passed in 2008 that increases the government's ability to intercept international communications.

Convicted Al-Qaeda Terrorists Appeal To The European Court Of Human Rights

Al-Qaeda Terrorists Launch Human Rights Bid -- The Telegraph

Two Al-Qaeda terrorists, one of whom plotted to kill thousands of people in a bomb attack on a British shopping centre, have launched an attempt to have their convictions quashed on human rights grounds.

The pair have applied to the European Court of Human Rights after claiming MI5 was complicit in their torture by Pakistani security services, a claim that has already been rejected by British courts.

Officials at the European Court have allowed their application to go ahead rather than declaring it inadmissible, as they do with thousands of cases a year.

Who the hell is David Barron?

Wikipedia says that name may refer to a British film producer, a soccer player, an actor or a sportswriter. Google says he could be a hairstylist in Atlanta. None of these, though, is the David Barron I have in mind. The one I want is the one who signed off on the killing of Anwar al-Awlaki, a very bad guy but, still, an American citizen. Barron was a U.S. government lawyer.

Never heard of him? Me neither. But according to published reports, he was one of two lawyers in the Justice Department’s Office of Legal Counsel — the other was Martin Lederman — who in 2010 composed an approximately 50-page memo saying it was legally permissible to kill Awlaki even though he was a U.S. citizen and had not been convicted of so much as a traffic violation.

My Comment: I admit .... when I first heard about the killing of Anwar al-Awlaki .... I was happy to know that he was now dead. But now .... a week later .... some small doubts are starting to come in. He was after-all an American citizen, and his assassination by the US government now opens a Pandora's box of how far will the US government now go against it's own citizens without due legal process. In the case of Anwar al-Awlaki .... it is clear that they will go all the way.

Bill Introduced To Strip Citizenship Of Americans Supporting Terror Abroad -- Daily Caller

A new bill introduced by Connecticut independent Sen. Joe Lieberman and several other members of Congress would strip the citizenship of Americans deemed by the government to be involved in terrorism.

Lieberman introduced the “Enemy Expatriation Act” Wednesday with Massachusetts Republican Sen. Scott Brown, Pennsylvania Republican Rep. Charlie Dent and Pennsylvania Democratic Rep. Jason Altmire. The legislation would update federal law to revoke the citizenship of Americans involved in terrorism.

Al-Qaeda Joins Those Questioning Legality Of U.S. Killing Of Citizen Anwar al-Awlaki -- Washington Post

Al-Qaeda’s affiliate in Yemen has confirmed the deaths of American-born cleric Anwar al-Awlaki and Samir Khan, the young American propagandist killed alongside him in a U.S. drone strike late last month.

Al-Qaeda has also criticized the Obama administration for killing U.S. citizens, saying doing so “contradicts” American law.

“Where are what they keep talking about regarding freedom, justice, human rights and respect of freedoms?!” the statement says, according to a translation by SITE Intelligence Group, which monitors jihadist Web sites.

WASHINGTON—The Supreme Court upheld a federal law banning "material support" for foreign terrorist organizations, rejecting challenges that the measure was so broad as to impinge on U.S. citizens' First Amendment rights of free speech and association.

The vote was 6-3, with Chief Justice John Roberts writing for the majority, joined by four other conservatives and liberal Justice John Paul Stevens. Justices Ruth Bader Ginsburg, Sonia Sotomayor and Stephen Breyer dissented.
