Axios Says President Trump Is Planning To Pardon Former National Security Adviser Michael Flynn

President Trump has told confidants he plans to pardon his former national security adviser Michael Flynn, who pleaded guilty in December 2017 to lying to the FBI about his Russian contacts, two sources with direct knowledge of the discussions tell Axios.

Behind the scenes: Sources with direct knowledge of the discussions said Flynn will be part of a series of pardons that Trump issues between now and when he leaves office.

The big picture: Flynn's pardon would be the culmination of a four-year political and legal saga that began with the FBI's investigation into possible coordination between the Trump campaign and the Russian government in the 2016 election.

Daily Mail: Unsealed documents suggest Joe Biden 'personally raised the idea' of investigating Michael Flynn over his ties to Russia

* Partly-redacted handwritten notes by ex-FBI Agent Peter Strzok suggest it was Biden who raised the idea Flynn may have violated the Logan Act
* 'VP: "Logan Act."' read Strzok's notes, dated January 4, 2017 and attached to federal court papers filed Wednesday by Flynn's defense team
* Flynn's defense lawyers said in the court filing the notes suggest 'Vice President Biden personally raised the idea of the Logan Act'
* Biden in May said he knew 'nothing' of the Obama administration's moves to investigate Flynn before backpedaling to say he misunderstood the question
* A US appeals court directed a federal judge Wednesday to drop the criminal case against Flynn and let him withdraw his guilty plea

Newly unsealed documents suggest Joe Biden 'personally raised the idea' of investigating former National Security Adviser Michael Flynn over his ties to Russia.

U.S. Appeals Court Orders Dismissal Of All Charges Against Former US National Security Adviser Michael Flynn

The Hill: Appeals court orders judge to dismiss Flynn charges

A federal appeals court on Wednesday ordered a judge to grant the Department of Justice's (DOJ) unusual move to drop charges against former national security adviser Michael Flynn.

A three-judge panel on the D.C. Circuit Court of Appeals approved Flynn's petition to intervene in the case after a district court judge had tapped an outside counsel to argue against the DOJ's move.

The panel ruled 2-1, with two Republican-appointed judges carrying the majority, that U.S. District Judge Emmet Sullivan overstepped his authority in second-guessing the prosecutors' decision.

Top FBI Lawyer To Resign Following Criticism Over His Handling Of The Mike Flynn Case And The Signing Of FISA Warrants

Acting Deputy Attorney General Dana J. Boente looks on while Attorney General Jeff Sessions speaks during a meeting with the Organized Crime Council and Organized Crime Drug Enforcement Task Force Executive Committee

NBC: FBI's top lawyer, Dana Boente, ousted amid Fox News criticism for role in Flynn investigation

Boente was asked to resign on Friday and two sources familiar with the decision to dismiss him said it came from high levels of the Justice Department rather than directly from FBI Director Christopher Wray.

After a 38-year career with the Justice Department, the FBI's top lawyer Dana Boente was asked to resign on Friday. Two sources familiar with the decision to dismiss Boente said it came from high levels of the Justice Department rather than directly from FBI Director Christopher Wray.

His departure comes on the heels of recent criticism by Fox News for his role in the investigation of former Trump National Security Advisor Michael Flynn.

A spokesman for the FBI confirmed to NBC News that Boente did in fact resign on Friday.

Fox News has recently criticized Boente's role in the investigation of Flynn, whose criminal charge for lying to the FBI was recently dropped by the Justice Department based in part on the argument that his lies were not material to an underlying investigation.

Trump Administration Sends List To Congress Of Obama Officials Who 'Unmasked' Former National Security Adviser Michael Flynn

Lashing out: In an interview with Fox Business Network airing in full Thursday, Trump attacked Biden and claimed 'we caught them'

Daily Mail: Donald Trump claims Joe Biden was a 'big unmasker' as Obama's VP revealed to have had Mike Flynn's name unmasked - then tears into 'sleazebags' and claims 'this was all Biden, we caught them'

* Acting DNI Ric Grenell ordered the information declassified this month
* Biden as among a group of officials who got unmasking information on Flynn in the final days of the Obama administration
* Flynn's contacts with Russia's ambassador to the U.S. picked up by U.S. intercepts; the contacts would eventually leak days before Obama left office
* Flynn pleaded guilty to lying to the FBI about his Russia contacts and was fired as Donald Trump's national security advisor
* Trump referred to FBI officials who prosecuted Flynn as 'sleazebags'
* The government switched positions and moved to drop the case against Flynn despite his guilty plea
* Federal judge overseeing Flynn's case appointed an outside retired judge to argue against the government's position

Former Vice President Joe Biden was identified Wednesday as being among a group of Obama administration officials who 'unmasked' the name of Mike Flynn in U.S. intelligence reports.

A National Security Agency document signed by Director General Paul Nakasone lists Biden as among those who requested and may have received information on Flynn in the final days of the Obama administration or were otherwise involved in his unmasking.

The leaked memo immediately set off a clash in Washington, with President Donald Trump tearing into Biden, his presumed 2020 opponent, for unmasking, which he connected to the prosecution of Flynn, which he termed a disgrace.

Former vice president Joe Biden appears on a declassified list of Obama administration officials who requested the unmasking of former Trump administration national security adviser Michael Flynn.

The list, obtained by CBS News, shows that Biden’s office made its request to see Flynn’s identity on January 12, 2017 — the same day that Washington Post columnist David Ignatius broke news of Flynn’s calls with then-Russian Ambassador Sergey Kislyak. While the NSA says it “cannot confirm” that those listed personally saw the information, the list also names former U.N. ambassador Samantha Power, former director of national intelligence James Clapper, former CIA director John Brennan, and former FBI director James Comey.

President Obama Says US 'Rule Of Law' At Risk After Flynn Case Dropped

Yahoo News: Exclusive: Obama says in private call that 'rule of law is at risk' in Michael Flynn case

WASHINGTON — Former President Barack Obama, talking privately to ex-members of his administration, said Friday that the “rule of law is at risk” in the wake of what he called an unprecedented move by the Justice Department to drop charges against former White House national security adviser Michael Flynn.

In the same chat, a tape of which was obtained by Yahoo News, Obama also lashed out at the Trump administration’s handling of the coronavirus pandemic as “an absolute chaotic disaster.”

“The news over the last 24 hours I think has been somewhat downplayed — about the Justice Department dropping charges against Michael Flynn,” Obama said in a web talk with members of the Obama Alumni Association.

WNU Editor: Transcripts that no one thought would ever see the light day are released by the House Intelligence Committee this past Thursday. And among the many bombshells that were disclosed was this one .... Declassified Documents Reveal That President Obama Knew Details Of Wiretapped Phone Calls Of Incoming Trump National Security Adviser Michael Flynn (May 8, 2020). In short. President Obama knew the details of wiretaps on President Trump National Security Adviser. Or to put it more bluntly. His administration was listening in (and reporting to President Obama) details of conversations involving President Trump's top national security adviser. The next question that then needs to be answered by the former President is this one. When did he know that President Trump's top national security adviser's conversations were being monitored, and why did he not stop it? The implications of President Obama using the intelligence agencies/Justice Department to spy on his opponent are huge, and I am sure the former President is aware of that.

So here is some of my speculation/analysis, and you tell me where I may be wrong (or right).

On Friday a conference phone call is quickly arranged between former President Obama and some of his closest allies to respond to Thursday's House Intel document dump implicating the former President on Michael Flynn's wiretaps. The next day former President Obama's remarks are leaked, starting with the 'rule of law is at risk' in the Michael Flynn case. That leak made me raise my eyebrows. President Obama ran an administration on a very tight leash, and there were rarely any leaks. That is why I know this leak was deliberate, and this is the reason why. What former President Obama is doing right now is a deflection. With his accusation that President Trump's response to the pandemic is chaotic to the Michael Flynn ruling puts the "rule at law at risk" .... what he wants right now is to change the narrative away from what was revealed on Thursday. And what is the narrative that he is trying to change? The monitoring of President Trump's top intelligence adviser and his communications, and the role that the former President played in it. I could be wrong .... and I hope that I am. But my gut is telling me that we are going to learn more in the coming days/weeks/and months. That besides monitoring Trump officials like Carter Page during the campaign, the Obama administration were also monitoring other members of the Trump team. That this monitoring intensified after he had won the nomination, and increased even more so after he had won the election. Michael Flynn may just be the tip of a very big iceberg, and I think that is what President Trump has been alluding to in the past few weeks. So what is next? Former President Obama was startled with what he saw on Thursday, and he has now gone public in his attacks against President Trump. I am even willing to bet that we are going to see more of the former President than former Vice President Biden and presumed Democrat Presidential nominee in the coming weeks. Will the former President be successful? I am not sure. I am someone who never underestimated the former President. As a politician he is one of the best, and one of the most ruthless. These leaks tell me that he has made a decision to not stay on the sidelines, and that he is now going to do everything in his power to make sure that President Trump is defeated in November, and that any inquiry in his role on the spying of Trump administration officials is all buried in a Biden administration.

Declassified Documents Reveal That President Obama Knew Details Of Wiretapped Phone Calls Of Incoming Trump National Security Adviser Michael Flynn

FOX News: Obama knew details of wiretapped Flynn phone calls, surprising top DOJ official in meeting with Biden, declassified docs show

President Obama was aware of the details of then-incoming national security adviser Michael Flynn's intercepted December 2016 phone calls with then-Russian Ambassador Sergey Kislyak, apparently surprising then-Deputy Attorney General Sally Yates, according to documents released Thursday as exhibits to the government's motion to dismiss the Flynn case.

Obama's unexpectedly intimate knowledge of the details of Flynn's calls, which the FBI said at the time were not criminal in nature, raised eyebrows because of his own history with Flynn -- and because top FBI officials secretly discussed whether their goal was to "get [Flynn] fired" when they interviewed him in the White House on January 24, 2017.

Update: BOMBSHELL: Obama Knew of Flynn Wiretaps, Declassified Docs Show (PJ Media)

WNU Editor: First things first. No one else in the media is carrying this story (so far). That is too bad. Deputy Attorney General Sally Yates remarks on President Obama's awareness that Michael Flynn was being wiretapped are truly eye-opening. Bottom line. We have sworn testimony from a Deputy Attorney General that President Obama was fully aware that a senior official in Trump's incoming administration was being spied upon by his administration. I have always wondered on when did President Obama knew that the Justice Department and other related agencies were "spying" on Trump officials. We now know through these declassified documents that President Obama was fully aware on January 5, 2017 on what was happening. This is, to put it bluntly, the "smoking gun". The mainstream media will try to bury this story, and the former President's supporters will give him a pass. But this story is not going to die. According to Susan Rice's testimony, it looks like former Vice-President Biden was also in this meeting, which means he was aware of what was happening.

U.S. Justice Department Has Dropped All Charges Against Former National Security Adviser General Flynn

Daily Mail: Bill Barr's Justice Department DROPS case against Mike Flynn for lying to the FBI even though he pleaded GUILTY - and triumphant Donald Trump accuses 'Obama' officials of 'treason' for bringing case

* Justice Department abruptly drops highest-profile case brought by Robert Mueller saying it is ending prosecution of Mike Flynn
* Donald Trump's first national security adviser had pleaded guilty to lying to the FBI in a plea deal with Mueller's prosecutors
* Flynn told a judge under oath that he was guilty - but he tried to withdraw that plea after changing lawyers
* Now the DOJ says a review of the case by a U.S. attorney picked by Bill Barr has led to it dropping the prosecution
* Career prosecutor who oversaw the case quit minutes before the move was announced
* DOJ said Barr had 'agreed' with the move, which came after furious tweeting by the president
* Decision means Trump can avoid questions on whether he will pardon Flynn
* Trump called government prosecutors 'human scum'

Attorney General Bill Barr's Justice Department said Thursday it was dropping its criminal case against fired Trump national security advisor Michael Flynn – who has pleaded guilty to numerous charges in federal court.

The stunning turnaround drew immediate praise from Trump, who has long claimed Flynn was railroaded and had kept alive the possibility of a presidential pardon while attacking prosecutors he said were on a 'witch hunt.'

President Trump reacted in the Oval Office by saying Flynn 'was an innocent man.'

'Now in my book he's an even greater warrior,' the president said.

Trump said he would reach out to Flynn at the 'appropriate' time.

'I think he’s a hero. It’s a scam. It was a scam and a hoax. I think he’s a hero, the general,' Trump said.

WNU Editor: The government's reasoning for dropping the case is the following .... the government has concluded that the interview of Mr Flynn was untethered to, and unjustified by, the FBI counterintelligence investigation...government is not persuaded that the January 24 2017 interview was conducted with a legitimate investigative basis (CBS). More here .... The investigation of Flynn was based "solely on his calls with Kislyak." "The calls were entirely appropriate on their face." (Techno Fog). The complete government document to dismiss is here (Flynn Motion to Dismiss). As to what is my take. When General Flynn pleaded guilty I mentioned at the time that when you are in government and you lie to Justice officials, you will have to suffer the consequences. Having said that. The actions of former FBI Director Comey and other senior FBI officials who deliberately sent in the investigators to entrap General Flynn (see here) was and is reprehensible.  Especially since we only learned last week that the FBI knew General Flynn had did nothing wrong, but decided to target him anyway (see here). What General Flynn did was bad. But what these FBI officials did was (and is) far worse.

Update: The reaction has been predictable .... from Congressman Nadler and Chair of the House Judiciary Committee (see link here), and from former FBI Director Comey (see link here).

Update #2: President Trump has responded.

Unsealed FBI Handwritten Notes And Emails Disclose How FBI And US Justice Department Officials Were Plotting A Perjury Trap Of Trump National Security Adviser Michael Flynn

SaraCarter: Powell: Unsealed FBI Handwritten Notes And Emails Reveal Agents Plotted Perjury Trap On Flynn

U.S. District Court Judge Emmet G. Sullivan unsealed four pages of stunning FBI emails and handwritten notes Wednesday, regarding former Trump National Security Advisor Michael Flynn, which allegedly reveal the retired three star general was targeted by senior FBI officials for prosecution, stated Flynn’s defense attorney Sidney Powell. Those notes and emails revealed that the retired three-star general appeared to be set up for a perjury trap by the senior members of the bureau and agents charged with investigating the now-debunked allegations that President Donald Trump’s campaign colluded with Russia, said Sidney Powell, the defense lawyer representing Flynn.

Moreover, the Department of Justice released 11 more pages of documents Wednesday afternoon, according to Powell.

WNU Editor: Why has it taken this long to release these documents? We have learned in the past few years on the corruption and politicization of the Justice Department that would make what happened with Watergate pale in comparison. But these communications go to a whole different level. We basically have senior Justice Department officials deliberately targeting President-elect Trump officials, and they felt completely comfortable to write handwritten notes and emails detailing their intentions without any worry that they may one day be made public. Talk about having a sense of entitlement and confidence that they are untouchable. These corrupt officials need to be held accountable for the great harm that they have done to the FBI and the Justice Department, and we need to know if their superiors and the White House were aware of this. I am willing to bet that they were.

And now the FBI is admitting that they have LOST their records of General Michael Flynn, the same records that were used to indict him and used to get a plea deal from him?!?!?!? This whole thing stinks. I for one would not be surprised if a full pardon is granted. As for the FBI officials responsible for safe-guarding these files. Who are they and are they being punished? It Was President Trump's Former National Security Adviser's Blunt Interview On Afghanistan That Kicked Off The Washington Post Investigation And Bombshell Report On The Afghan War

Then-Maj. Gen. Michael Flynn, the senior intelligence officer in Afghanistan, aboard an Italian CH-47C Chinook helicopter in Afghanistan in 2010. Defense Department

Business Insider: Mike Flynn's blunt interview with staffers kicked off the investigation into a bombshell Afghanistan report

  * Retired US Army Lt. Gen. Michael Flynn, President Donald Trump's first national security adviser, is in the spotlight for his critical statements on America's war in Afghanistan.
  * His statements prompted an extensive Washington Post investigation, published Monday, that uncovered a candid history of the war that revealed the US government had largely misled the public.
  * The Post, stumbling upon a secret government review, found that officials and advisers from the White House and the Pentagon held private reservations about the war even as they publicly peddled an optimistic view of Afghanistan's progress.
  * "From the ambassadors down to the low level, [they all say] we are doing a great job," Flynn told government investigators, according to documents and audio recordings obtained by The Post. "Really? So if we are doing such a great job, why does it feel like we are losing?"

Retired US Army Lt. Gen. Michael Flynn, President Donald Trump's first national security adviser, is in the spotlight for his past statements about America's war in Afghanistan.

The Washington Post on Monday said it was those statements, which it received a tip about years ago when Flynn emerged as a prominent campaign surrogate for Trump, that prompted its extensive investigation into the US government's history of misleading characterizations of the war.

The full Post report on Monday into what are now dubbed "The Afghanistan Papers" detailed a secret government review in which hundreds of people involved in the war effort were interviewed. Many, including senior officials, were found to have held private reservations about the war effort even as the White House and the Pentagon publicly peddled an optimistic view of Afghanistan's progress.

More Disturbing Disclosures From The General Michael Flynn Prosecution

Power Line: More Bombshells From the Flynn Prosecution

General Michael Flynn still awaits sentencing. Meanwhile his new lawyer, Sidney Powell, is tormenting the prosecutors and the FBI, uncovering corruption in the FBI and the Department of Justice that, she credibly alleges, included the framing of General Flynn.

Is that too strong? I don’t think so. Yesterday Powell filed a reply brief in support of her motion to compel the production of more exculpating material by the prosecution, and to hold the prosecutors in contempt of court. Her recitation, which relies in part on text messages that I take it have come to light recently, makes a compelling case of FBI and prosecutorial misconduct. The reply brief is embedded below; I encourage you to read it in its entirety.

WNU Editor If half of what General Flynn's lawyer Sidney Powell is saying is true, and the documents that have been given to her from the Justice Department seems to prove her case that then National Security Adviser Michael Flynn was being deliberately set-up by the FBI, I do not see how the judge can sentence General Flynn to jail. In fact. I can easily see this case being dismissed. The sentencing of General Flynn is suppose to take place in December. I am willing to bet that it is going to be delayed. On a side note. Two years ago the main stream media was covering the case of President Trump's National Security Adviser Michael Flynn non-stop. Today, there is little if any coverage.

The Case Against President Trump’s Former National Security Adviser Is Implicating Former Top Obama Intelligence And FBI Officials In Targeting Him

American Greatness: Flynn Attorney Accuses Government Prosecutors of Suppressing Evidence the Defense Uncovered

In a scorching court filing Wednesday, Gen. Michael Flynn’s legal team accused Department of Justice prosecutors of stonewalling and suppressing exonerating evidence the defense itself uncovered.

Lead counsel Sidney Powell also accused “certain elements in the government” of targeting Flynn, President Trump’s former national security adviser, for destruction because he had “publicly expressed intent to audit the intelligence agencies where billions of dollars are unaccounted for.”

WNU Editor: The case against President Trump’s Former National Security Adviser Michael Flynn has just gotten interesting. Michael Flynn's lawyer has discovered that prosecutors did not only hide evidence that they knew would exonerate Mr. Flynn, but she discovered the following .... senior US Justice official Lisa Page edited Mr. Flynn's 302 and lied about it (A 302 summary report consists of contemporaneous notes taken by an FBI agent when interviewing a subject). And more explosively, former National Security Adviser James Clapper is most likely the leaker of Flynn’s phone call with Russian Ambassador Kislyak to Washington Post reporter David Ingatius. Apparently he even told WaPo reporter Ignatius to "take the kill shot on Flynn". If you have an hour and want to read all of these documents, grab a cup of coffee and go to the above tweet.

The Case Of Former U.S.National Security Adviser Michael Flynn Just Got Interesting

Daily Mail/AP: Donald Trump's first national security adviser Mike Flynn's attorneys accuse prosecutors of 'misconduct' by failing to hand over the FBI lovers' anti-Trump texts and call for case to be dismissed

* Mike Flynn, a former three-star general, was Trump's first national security advisor until he was fired less than a month after the inauguration
* He pleaded guilty in a plea bargain cut with prosecutors from the Mueller special counsel probe and is now waiting to be sentenced
* But his new defense team are accusing federal prosecutors of 'egregious misconduct' claiming Flynn was not given all the facts before making a deal
* Among the missing information, they claim, were the notorious anti-Trump texts exchanged by FBI lovers Lisa Page and Peter Strzok
* Flynn's attorney Sidney Powell said the whole prosecution should be dismissed
* U.S. District Judge Emmet Sullivan set a Dec. 18 sentencing date for Flynn
* Prosecutors had previously offered a probation recommendation but that now appears to be in jeopardy

A lawyer for Michael Flynn accused federal prosecutors of misconduct on Tuesday as a judge set a December sentencing hearing for President Donald Trump's former national security adviser.

The arguments from Flynn attorney Sidney Powell were the latest in a series of aggressive attacks on the foundations of special counsel Robert Mueller's Russia investigation.

They represented yet another step in Flynn's evolution from a model cooperator - he was the first and only White House official to cut a deal with prosecutors - to a defendant whose newly combative and unremorseful stance may cost him a chance at the probation sentence prosecutors had previously recommended.

WNU Editor: If true, there is a very real possibility that this entire may be thrown out by the judge.

Did Michael Flynn Promise Support To A U.S.-Russian Plan To Build Nuclear Reactors Across The Middle East?

Reuters: Exclusive: Mideast nuclear plan backers bragged of support of top Trump aide Flynn

WASHINGTON (Reuters) - Backers of a U.S.-Russian plan to build nuclear reactors across the Middle East bragged after the U.S. election they had backing from Donald Trump’s national security adviser Michael Flynn for a project that required lifting sanctions on Russia, documents reviewed by Reuters show.

The documents, which have not previously been made public, reveal new aspects of the plan, including the proposed involvement of a Russian company currently under U.S. sanctions to manufacture nuclear equipment. That company, major engineering and construction firm OMZ OAO, declined to comment.

The documents do not show whether Flynn, a retired Army lieutenant general, took concrete steps to push the proposal with Trump and his aides. But they do show that Washington-based nuclear power consultancy ACU Strategic Partners believed that both Flynn, who had worked as an adviser to the firm as late as mid-2016, and Trump were firmly in its corner.

WNU Editor:  I am skeptical of this report. The idea that the Russian company responsible for that country's nuclear program would entertain the idea of forming a joint venture with an American firm to build nuclear reactors across the Middle East sounds far fetched to me. Did people talk and make plans about it .... probably. But would they go beyond just talking and sending emails to each other  .... like I said .... I am skeptical.

Is It Against The Law For President-Elect Trump To Order His Soon To Be National Security Adviser To Talk To Russia?

Former U.S. National Security Adviser Michael Flynn is escorted into a plea hearing at U.S. District Court, where he’s expected to plead guilty to lying to the FBI about his contacts with Russia's ambassador to the United States, in Washington, U.S., December 1, 2017. Reuters

Reuters: Flynn prepared to testify Trump directed him to contact Russians: ABC

WASHINGTON (Reuters) - ABC News reported on Friday that former U.S. national security adviser Michael Flynn is prepared to testify that President Donald Trump directed him to make contact with Russians when he was a presidential candidate.

Reuters could not immediately verify the report, which cited a Flynn confidant. The news sent U.S. stocks sharply lower.

Flynn, a former top Trump campaign aide and a central figure in a federal investigation into Moscow’s alleged interference in the 2016 U.S. presidential election, pleaded guilty on Friday to lying to the FBI.

His plea agreement, and his decision to cooperate with the investigation led by Special Counsel Robert Mueller, marked a major escalation in a probe that has dogged Trump’s administration since the Republican president took office in January.

WNU Editor: This ABC report and innuendo is so bogus that I do not even know where to begin. President Trump was elected on a platform that included having better relations with Russia .... especially in the war against ISIS .... and it would therefore not surprise anyone that he would have directed someone like his future National Security adviser (i.e. Michael Flynn) to develop contacts with the Russian government. These type of discussions are not against the law. The plea deal is also very clear .... this is not a plea to an espionage scheme, it is a plea to a process crime. To put it bluntly .... the Meuller Commision has no proof that a scheme to work and collude with the Russians to impact the election is present in today's court revelations .... none .... zero. The only thing that the Mueller Counsel now has is the Manafort case .... and that has nothing to do with Russian collusion.

Update: The complete agreement between Michael Flynn and the Special Counsel can be read here (need to scroll down) .... Michael Flynn Just Flipped on Team Trump (Daily Beast).

Update #2: There is still one question that remains to be answered .... and that is why did Michael Flynn lied? Lie to the FBI, and lying to Vice President Pence. We still do not know the answer to that.
